1. Supplier and contact details

2. Orders and acceptance

Products displayed on the website are offered subject to availability. Placing an item in a shopping bag does not reserve stock. An order is subject to confirmation of stock, the accuracy of the order information and successful payment or payment authorisation where applicable.

If an item becomes unavailable, or an obvious pricing or catalogue error prevents us from fulfilling the order as placed, we will contact you as soon as reasonably possible. Where payment has already been received for an item that we cannot supply, the applicable amount will be refunded.

3. Prices and payment

Prices are displayed in South African rand. The final payable amount, including the delivery charge, is shown before the customer commits to payment. KALM Collective is not registered for VAT and does not charge VAT unless this is expressly stated in a future valid tax invoice. KALM Collective does not collect or store full card details on the storefront. Payments for the current launch are processed through PayFast and are also subject to PayFast's applicable terms.

4. Delivery

Standard courier delivery is available within South Africa for the charge displayed at checkout, currently R99. Our current standard delivery estimate is 2 to 5 business days after verified payment and order confirmation. The current launch does not offer express delivery or collection at checkout.

5. Order cancellation

Before dispatch

To request cancellation before an order has been dispatched, email support@kalmcollective.co.za as soon as possible with the order number. If the order has not yet entered dispatch, we will cancel it and arrange a refund of any amount already paid.

After dispatch or delivery

If the order has already been dispatched, the customer may use the return and cancellation rights set out below. For an electronic transaction to which section 44 of the Electronic Communications and Transactions Act 25 of 2002 applies, a consumer may cancel a transaction for goods without reason and without penalty within seven days after receipt of the goods. The direct cost of returning the goods may be for the consumer's account, and any refund due under that statutory cooling-off right will be processed within the period required by law.

6. Returns

In addition to statutory rights, KALM Collective accepts eligible change-of-mind returns within 30 days of delivery.

For a change-of-mind return outside any mandatory statutory cooling-off period, the item should be:

For hygiene reasons, a change-of-mind return may be declined for goods that cannot reasonably be resold once opened, worn or used. This does not remove any statutory right relating to defective, unsafe, incorrectly supplied or misdescribed goods.

To start a return, contact support@kalmcollective.co.za with the order number, item and reason for the return. We will provide the return instructions and, where applicable, collection or courier details.

7. Refunds

Once a returned item has been received and validated, an eligible refund will be made to the original payment method where reasonably possible.

We aim to initiate validated refunds promptly. Bank or payment-provider processing times may affect when the funds appear in the customer's account. Where legislation prescribes a specific refund deadline, that statutory deadline will apply.

8. Product descriptions, archive stock and availability

We take reasonable care to describe products accurately and to keep stock information current. Screen settings may affect the way colours appear. Archive products may have limited size and colour availability. Any material condition note specific to an archive item will be disclosed on the product page where applicable.

9. Incorrect, damaged or defective goods

Please notify us as soon as reasonably possible if an item arrives damaged, is not the item ordered, is materially different from its description or appears defective. We may ask for photographs or other reasonable information to assess the issue and arrange the appropriate remedy. Nothing in this process limits the consumer's rights under the Consumer Protection Act 68 of 2008 or other applicable law.

10. Payment security

PayFast is the payment gateway for the current launch. The customer is redirected to PayFast's secure payment environment to enter card or other payment details. KALM Collective does not ask customers to send full card details by ordinary email, and a return to this website is not treated as proof of payment until the gateway notification has been verified.

11. Privacy and marketing

Customer information is processed for order fulfilment, delivery, customer care, fraud prevention, legal and accounting obligations, and marketing only where the customer has separately opted in. We collect only the information needed for those purposes. Order information is retained for the period required for legitimate operational, tax and legal purposes; marketing preferences are retained until withdrawn or reviewed after inactivity. Personal information is handled in accordance with applicable South African privacy law, including POPIA. To withdraw marketing consent, use the marketing preference page or email support@kalmcollective.co.za. You may raise a privacy question at the same support address.

12. Cookies and local storage

The website uses essential browser storage to keep a shopping bag and selected KALM Move launch-interest choices during the browsing session. KALM Collective does not use advertising trackers as part of this Phase 1 checkout. Where non-essential analytics or marketing technology is added, this notice and any required consent process will be updated before use.

13. Website use

The website and its content are provided for lawful personal shopping and information purposes. Users may not interfere with the operation or security of the website, attempt unauthorised access, or use automated means in a way that materially disrupts the service.

14. Changes to these terms

We may update these terms when our services, payment methods, delivery arrangements or legal obligations change. The version published at the time of an order will apply to that order to the extent permitted by law.

15. Governing law

These terms and online transactions with KALM Collective are governed by the laws of the Republic of South Africa. Nothing in these terms excludes or restricts a consumer protection that cannot lawfully be excluded or restricted.
